“CONVENIO DE COOPERACIÓN TURÍSTICA ENTRE LOS MUNICIPIOS DE ANGOL, CURACAUTIN Y LOS ANGELES”
En Los Ángeles a 04 de diciembre de 2009, entre la Ilustre Municipalidad de Angol, Corporación de Derecho Público, representada por su Alcalde Sr. JOSÉ ENRIQUE NEIRA NEIRA , RUT Nº 6.535.099-8 , la Ilustre Municipalidad de Curacautín, Corporación de Derecho Público, representada por su Alcalde Sr. JORGE ROLANDO SAQUEL ALBARRÁN , RUT Nº 6.638.343-1 y la Ilustre Municipalidad de Los Angeles, representada por su Alcalde Don JOEL ROSALES GUZMÁN, RUT Nº 6.666.509-7.
Los comparecientes en la representación que invisten señalan que:
Considerando la importancia que el desarrollo de las relaciones turísticas pueda tener, no solamente en favor de las respectivas economías, sino también para fomentar un profundo conocimiento entre las comunas.
Convencidos de que el turismo en razón de su dinámica socio-cultural, económica y ambiental es un excelente instrumento para promover el desarrollo económico, el entendimiento, la buena voluntad y estrechar las relaciones entre las comunas.
Deseando emprender una estrecha colaboración en el campo del turismo y de lograr una mayor coordinación e integración de los esfuerzos que realiza cada comuna para incrementar y consolidar el turismo interno entre ambos destinos y un mejor aprovechamiento de los recursos naturales y culturales;
En atención a lo expresado precedentemente han convenido lo siguiente:
PRIMERO: Oficinas Turísticas
De conformidad a los planes de desarrollo turístico desarrollados por SERNATUR, las oficinas de turismo de los municipios miembros de este convenio, promoverán el intercambio turístico, promocional, cultural y ambiental.
Para el logro de los objetivos anteriormente señalados, las partes entregarán todas las facilidades a su alcance para la instalación y funcionamiento de las oficinas de turismo.
SEGUNDO: Desarrollo del Turismo
Las partes signatarias, de conformidad con su estructura orgánica interna facilitarán y alentarán las actividades de prestadores de servicios turísticos como: agencias de viajes, comercializadores y operadores turísticos, empresas hoteleras, sin perjuicio de cualquier otra entidad que pueda generar turismo recíproco entre las comunas parte de este convenio.
Asimismo, las partes acuerdan que, dentro de sus posibilidades, facilitarán el intercambio de funcionarios del área de turismo, a fin de obtener una mayor comprensión del desarrollo comunal de esta actividad.
TERCERO: Facilitación
Dentro de los límites establecidos por sus ordenanzas municipales, las partes fomentarán recíprocamente la intensificación del movimiento turístico de las personas y el intercambio de documentos y de material de propaganda turística, así como medios audiovisuales, y actividades turísticas, con la finalidad de mantener informadas a sus poblaciones sobre las posibilidades turísticas de las comunas suscribientes.
CUARTO: Inversión
Las partes promoverán y facilitarán los trámites y conductos regulares, de acuerdo con sus posibilidades y sus respectivas Ordenanzas, para que los empresarios y/o inversionistas puedan invertir o desarrollar el turismo interno.
QUINTO: Programas Turísticos y Culturales
En circunstancias excepcionales , los municipios miembros de este convenio podrán aportar fondos para el desarrollo de actividades concretas, previo acuerdo de los Concejos de las municipalidades respectivas; estos aportes serán iguales para cada Municipio.
Las partes alentarán las actividades de promoción turística con el fin de incrementar el intercambio, la divulgación de sus destinos y dar a conocer la imagen de sus respectivas comunas, participando en manifestaciones turísticas, culturales, recreativas, folclóricas, deportivas, organización de seminarios, exposiciones, congresos, conferencias, ferias y festivales de trascendencia nacional y/o internacional. Asimismo, cada uno de los municipios participantes en este convenio fomentará las visitas y los viajes de familiarización, incluyendo tours operadores y periodistas especializados y otros.
SEXTO: Investigación y Capacitación Turística
Los Municipios partes alentarán a sus respectivos expertos para intercambiar información técnica y/o documentación en los campos turísticos, ambientales y culturales.
Asimismo, cada parte desarrollará acciones que faciliten la cooperación entre profesionales de ambas comunas a fin de elevar el nivel de sus técnicos de turismo y fomentar la investigación y el estudio de casos conjuntos en materias de interés común.
SÉPTIMO: Intercambio de Información
Las partes intercambiarán información sobre:
a) Sus recursos turísticos y los estudios relacionados con el turismo y con los planes de desarrollo del turismo en las respectivas comunas;
b) Estudios e investigaciones relacionados con la actividad turística y documentación técnica periódica, tales como revistas y otros;
c) La legislación vigente para la reglamentación de las actividades turísticas, para la protección y conservación de los recursos naturales y culturales de interés turístico y otros.
d) Experiencias en procesos de integración provincial y regional en el campo turístico.
e) Las partes, a través de sus organismos oficiales de turismo, propiciarán el desarrollo de las relaciones entre sus empresas privadas de turismo y fomentarán la elaboración de programas de intercambio entre las mismas.
OCTAVO: Planes y programas de Desarrollo Turístico
En la ejecución del presente convenio los municipios deberán tener en consideración los Planes y Programas de DesarrolloTurístico propuesto por SERNATUR, para desarrollar y fomentar la adopción de modelos uniformes y prácticas recomendadas.
Las partes acuerdan brindarse asistencia recíproca en las cuestiones de cooperación y efectiva participación en el desarrollo del turismo.
NOVENO: Consultas
El presente Convenio se desarrollará a través de un cronograma de trabajo al que podrán ser invitados miembros del sector turístico privado y cuya finalidad será coadyuvar al logro de los objetivos del convenio.
El grupo de trabajo se reunirá alternadamente en las comunas participantes, con la frecuencia que determine el propio grupo, con la finalidad de evaluar las actividades realizadas al amparo del presente convenio.
DECIMO, el presente convenio entrará en vigor desde la suscripción de este documento por las comunas integrantes.
DECIMO PRIMERO, el presente convenio tendrá una duración de cuatro años, renovándose automáticamente por períodos iguales, a menos que una de las partes manifieste su deseo de darlo por terminado, lo que deberá comunicarlo a los otros municipios integrantes, por escrito y en un plazo no inferior a 60 días.
DECIMO SEGUNDO, el presente convenio podrá ser modificado con el consentimiento de las partes. Las modificaciones se formalizarán a través de los conductos regulares, existentes entre las signatarias.
DECIMO TERCERO, la terminación del presente convenio no afectará la realización de los programas y proyectos que hayan sido formalizados durante su vigencia, a menos que las partes lo acuerden de otra forma.
DECIMO CUARTO, la personería de don José Enrique Neira Neira para comparecer en representación de la Municipalidad de Angol, emana del decreto 1883 del 06 de Diciembre de 2008, la personería de Don Jorge Rolando Saquel Albarrán para representar a la Municipalidad de Curacautín emana del decreto N° 1602 de 06 de diciembre de 2008; Por último, la comparencia de Don Joel Rosales Guzmán para obligar a la Municipalidad de Los Ángeles, emana del decreto N° 2908 del 06 de Diciembre de 2008.
Suscrito en la , Comuna de Los Ángeles el día 04 de diciembre de dos mil nueve (2009), en tres ejemplares originales, siendo todos los textos igualmente auténticos.

"TOURIST COOPERATION AGREEMENT BETWEEN THE MUNICIPALITY OF ANGOL, CURACAUTIN AND LOS ANGELES"
In Los Ángeles on December 04, 2009, among the illustrious municipality of Angol, Public Law Corporation, represented by its Mayor Mr. JOSÉ ENRIQUE NEIRA NEIRA, RUT Nº 6.535.099-8, the illustrious municipality of Curacautín, Public Law Corporation, represented by its Mayor Mr. JORGE ROLANDO SAQUEL ALBARRÁN, Rut N° 6.638.343-1 and the municipality of Los Ángeles, represented by its Mayor Don JOEL ROSALES GUZMÁN, RUT Nº 6.666.509-7.
The appearing in the representation that invest indicate that:
Considering the importance of the development of tourist relations may have, not only on behalf of the respective economies, but also to promote a deep understanding between communities.
Convinced that tourism due to its socio-cultural, economic and environmental dynamics is an excellent instrument to promote economic development, understanding, good will and closer relations between the communes.
Wishing to undertake a close collaboration in the field of tourism and achieve greater coordination and integration of the efforts of each commune to increase and consolidate the internal tourism between both destinations and a better use of the natural and cultural resources;
According to the expressed have previously agreed the following:
FIRST: Tourist offices
According to tourism development plans developed by SERNATUR, offices of tourism of the municipalities members of this agreement, shall promote tourist, cultural, environmental and promotional exchange.
To achieve the above mentioned objectives, the parts delivered all the facilities at its disposal for the installation and operation of the tourist offices.
SECOND: Tourism Development
The signatories, in accordance with its internal organizational structure will facilitate and encourage the activities of providers of tourist services such as: travel agencies, traders and tour operators, hotel companies, without prejudice to any other entity that can generate reciprocal tourism between the communes under this agreement.
In addition, the parts agree that, within its possibilities, facilitate the exchange of officials in the tourism, in order to obtain a better understanding of the development of this activity.
THIRD: Facilitation
Within the limits established by its by their laws, parts reciprocally promote the intensification of tourist movement of persons and the exchange of documents and of tourist publicity material, as well as audiovisual media, and tourist activities, with the purpose of maintaining informed their populations about the tourist possibilities of the signatory communes.
FOURTH: Investment
The Parts shall promote and facilitate procedures and regular, in accordance with their possibilities and their respective Ordinances ducts, so entrepreneurs and/or investors can invest or develop domestic tourism.
FIFTH: Tourist and Cultural Programs
In exceptional circumstances, the municipalities members of this agreement may provide funds for the development of specific activities, prior agreement of the Councils of the respective municipalities; These contributions will be equal for each Municipality.
The Parts shall encourage the activities of tourism promotion in order to increase the exchange, dissemination of their destinies and to publicize the image of their respective communes, participating in tourist, cultural, recreational, folklore, sports demonstrations, seminars, exhibitions, congresses, conferences, fairs and national festivals or international significance. Also, each of the municipalities participating in this agreement will encourage visits and the familiarization trips, including tours operators and specialized journalists and others.
SIXTH: Research and Tourism Training
The municipalities parts shall encourage their respective experts to exchange technical information and/or documentation in the tourist, environmental and cultural fields.
In addition, each part will develop actions that would facilitate the cooperation between professionals from both communities in order to raise the level of its tourism technicians and encourage research and the study of joint cases in matters of common interest.
SEVENTH: Information exchanges
The Parts shall exchange information about:
(a) Their tourism resources and studies related to tourism and plans of development of tourism in the respective communes;
(b) Studies and research related to tourist activity and periodic technical documentation, such as magazines and others;
(c) The existing legislation for the regulation of tourism, for the protection and conservation of the natural and cultural resources of tourists interest and others.
(d) Experiences in provincial and regional integration in the tourism field.
(e) The parts, through their official organisms of tourism, will cause the development of the relations between their deprived companies of tourism and will foment the elaboration of programs of interchange between the same ones.
EIGHTH: Plans and programs of Tourist Development
In the implementation of the Convention the municipalities must take into consideration the plans and programs of tourism development proposed by SERNATUR, in order to develop and promote the adoption of uniform models and best practices.
The parts agree to provide mutual assistance in matters of cooperation and effective participation in the development of tourism.
NINTH: Consultations
This present agreement will be developed through a schedule of work members of the private tourism sector may be invited to that and whose purpose will be to contribute to the achievement of the objectives of the agreement.
The working group will meet alternately in participating districts, with the frequency determined by the group itself, in order to evaluate the activities carried out under the protection of the agreement.
TENTH, this convention shall enter into force from the signing of this document by the Member communes.
ELEVENTH, this convention will have a duration of four years, automatically renewed for equal periods, unless one of the Parties expresses his desire to so terminate, which shall communicate it to the other member municipalities, in writing and within a period of not less than 60 days.
TWELFTH, this convention may be amended with the consent of the parts. The modifications are formalized through regular, existing ducts between the signatories.
THIRTEENTH, the termination of this convention shall not affect the realization of programs and projects that have been formalized during his term, unless agreed otherwise by the parts.
FOURTEENTH, the personality of don José Enrique Neira Neira to represent the municipality of Angol, emanates from the 1883 Decree from 06 of December 2008, the status of Don Jorge Rolando Saquel Albarrán to represent the municipality of Curacautín emanates from Decree No. 1602 December 06 of 2008; Finally, the appearance of Don Joel Rosales Guzman to compel the municipality of Los Angeles, emanates from Decree N° 2908 of December 06, 2008.
Signed in the Commune of Los Ángeles the day 04 of december of twenty thirteen (2013), in three copies, all the texts being equally authentic.
